Terms and Conditions of Omio Customer Experience Survey “Win the cost of your journey” Promotion (EU)

1. Participation

The organizer of the Omio Customer Experience Survey Prize Promotion (the “Promotion”) is Omio Corp. (“Omio”).

The Promotion is open to any natural person who is resident in the European Union, has reached the age of eighteen at the time of entering the Promotion, and has unlimited legal capacity (the “Participant”). Participation in the Promotion is free to enter, and no purchase is necessary.

Employees of any company within the Omio group, as well as their immediate relations and/or those living in the same household as an employee of the Omio group, are excluded from participation.

Each Participant may participate in the Promotion only once and by using their own name.

2. Participation period

The survey will be live until September 30th, 2024.

3. Survey Prizes and procedure

3.1 Survey

The survey is designed to obtain information on consumer travel preferences and experience with the Omio website and app. The survey is being conducted on behalf of Omio by Typeform SL (“Typeform”), a company registered in Spain with a registered address at C/ Can Rabia 3-5, 4th floor, 08017 Barcelona, and tax identification number B65831836.

3.2 Prize

A prepaid debit card to the value of the most recent Omio journey booked with the email address through which you completed the survey, limited to a minimum of 30 Euros and a maximum of 500 Euros (the “Prize”), will be awarded to one randomly selected winner. Cards will be issued by iCard AD, Company number 175325806, with a registered office at Business Park Varna B1, Varna city, 9009 Republic of Bulgaria. The Terms and Conditions of iCARD AD apply. Payment of a cash equivalent of the Prize is not possible. Omio will not transfer or exchange the Prize.

4. Procedure

Participation in the Promotion is only possible by completing the survey through Typeform. The Participant must fully complete the survey in order to be eligible.

The winners will be selected by random draw from all complete entries.

The winners will be notified by email within two working days of the closing date and must respond by email within five working days of the notification email being sent in order to claim their Prize. Notifications shall be delivered to the same email address to which the survey link was sent. Winners must respond to the notification email in order to claim their prize. If a winner fails to claim their Prize within the specified time frame, they shall be deemed to have forfeited their Prize. If the notification email is undeliverable, the winner will also be deemed to have forfeited the Prize. An alternate winner shall be picked at random from the remaining pool of complete entries.

If a Participant is disqualified due to a violation of applicable law and/or these terms and conditions of participation, as well as in the event of modification, suspension, or termination of the Promotion by Omio, Participants shall not be entitled to any claims for compensation against Omio.

5. Miscellaneous

5.1 Governing law

These terms and conditions of participation and the legal relationship between the Participant and Omio shall be governed by the laws of Germany. Should individual provisions become invalid under applicable law, the remaining terms and conditions of participation shall remain valid.

5.2 Disqualification, modification, suspension, and termination

Omio reserves the right to disqualify any person who:

• provides false information when completing the survey
• completes the survey more than once
• manipulates or attempts to manipulate the outcome of the Promotion, or
• otherwise violates these terms and conditions of participation.

Omio may also modify, suspend, or terminate the Promotion due to force majeure or external circumstances beyond the control of Omio.

5.3 No affiliation

This promotion is in no way affiliated, sponsored, endorsed, or administered by iCARD AD.

6. Data protection notice

By participating in the promotion, you agree to the Terms and Conditions and Privacy Policy of Typeform. Typeform acts as a Data Processor as defined by Article 4 of EU Regulation 2016/679 (GDPR). By taking this survey, you consent to the processing of your data in this manner by Typeform.

By participating in the Promotion, you agree to be contacted by email in the event that you are selected as the winner. In the event that you are selected as the winner, you also agree to the iCARD AD Privacy Policy.

Consequences of failure to provide personal data: If you do not provide us with the personal data, you will not be able to participate in this contest.
Retention period: We will store your personal data for the duration of the contest and for as long as necessary to achieve the purpose of the contest.
Transfer to third parties: Yes, to Typeform. The winner will have their name and email address transferred to iCard AD for the purposes of issuing the Prize.

Omio uses a variety of technical and organizational methods to protect your personal data in accordance with applicable laws. To support this obligation, we have taken appropriate technical, physical, and organizational measures to ensure a level of security appropriate to the risk.
