2019 Advent Calendar Giveaway Terms & Conditions

1. The Omio Advents Calendar giveaway contests are run by Omio Travel GmbH, Warschauer Platz 12, 10245 Berlin, Germany.
2. By entering the contests each entrant agrees to be bound by these terms and conditions.
3. Entrants acknowledge that the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. As far as legally possible, entrants release Instagram from all liability in connection with the promotion.
4. Omio employees and their relatives are excluded from the contests.
5. Applicants must be of legal age in their respective jurisdiction.
6. The Omio Advents Calendar giveaway contests will run on the official Omio Instagram account.
7. There will be 6 giveaways between Dec. 1st and Dec. 24th 2019.
8. Each giveaway will include one unique Omio vouchers of 10% off. Terms and conditions of the Omio vouchers are here.
9. To participate in the giveaway contest, users need to answer the question asked in the Omio Instagram post by commenting on the same post.
10. The winner will be chosen randomly by using a 3rd party ‘random name picker’ online tool, like this one.
11. The closing date and time to enter the contest will be 24h after the post was posted on Instagram. After this time no further entries will be accepted.
12. The winner will be picked and notified by Omio in the comments of the post within 48h after the end of the contest.
13. The winner must contact Omio by Instagram private message to claim their prize within 7 days of Omio sending notification. If the prize is unclaimed after this time, it will lapse and Omio reserves the right to offer the unclaimed prize to a substitute winner.
14. Entries that are deemed inappropriate and/or offensive will not be included. Users are liable for the content of their entry. Only one entry per user is accepted.
15. There is no cost involved to enter.
16. Omio accepts no responsibility for entries not received.
17. A winner will forfeit his/her prize if he/she is in breach of any of the terms and conditions or has found to have manipulated the contest.
18. Data relating to entrants will be retained by Omio for a reasonable period after the contest closes to assist Omio to operate competitions in a consistent manner and to deal with any queries on the contest.
19. When users book a ticket our data protection policy and our general Terms and Conditions apply.
20. Omio will only be liable for intent and negligence, except in case of a negligent breach of an essential contractual commitment. In this case the liability of Omio with simple negligence is limited to the predictable damage which is typical for raffles. The limitation of liability is not valid in case of damage of life, body or health. There is no right of appeal. An enforceable claim for the winnings or the payout in cash does not exist.
21. The legal framework for the conditions of this competition is the law of the Bundesrepublik Deutschland, excluding international uniform law, especially the UN Sales Convention. The legal regulations for the choice of law and for the applicability of binding rules, especially of the state, in where the consumer usually lives, remains unaffected. The legal regulations are valid for the place of jurisdiction.
