The GoEuro and Omio brands are part of GoEuro Corp., a Delaware corporation with its operational headquarters located at Warschauer Platz 12, 10245 Berlin, Germany (“We,” “Us,” “Our,” “GoEuro” or “Omio”). GoEuro and its affiliate, Omio Travel GmbH , may be referred to hereinafter collectively as the “Omio Group.” For more information please visit our Imprint.
We help Our users and their travel companions (collectively “You,” “Your,” or “Users”) identify, compare, and purchase transportation services, whether directly for certain offers (“Direct Bookings”), or as an intermediary in collaboration with third-party providers (“External Bookings”) (collectively, the “Services”).
Omio Group does not provide any actual transportation services. We do not run tours; We do not own any of the unaffiliated third-party travel providers (collectively, “Providers”) nor are We under the economic control of any such Providers. We do not provide package holidays. We offer the Services via Our mobile applications (each, an “App”) and Our internet-based platforms and websites (collectively, “Websites”) (“App” and “Websites” may be referred to collectively as the “Service Sites”).
To the extent that the Policies should conflict with the details set forth in a subsequent individual agreement between Omio Group and You, for example as part of a customized booking, the terms of such ad-hoc agreement will govern.
In addition to the Policies, the terms and conditions of each respective Provider (“Provider Terms”) will govern the products and services offered by such Providers and Your agreement with them. Therefore, Provider Terms may apply to any External Bookings or third-party booking platforms to which You are linked to via the Services. We have no influence over, and are not responsible for, the terms and conditions of any such unaffiliated third-parties, including any Provider Terms.
You are solely responsible for preventing the unauthorized access and use of Your credit cards, payment methods, Your Omio account, and Your devices. You shall maintain the confidentiality of Your Omio account credentials, and You agree to accept responsibility for any and all activities or actions that occur under Your Omio account. You accept all responsibility for any consequences, whether financial or otherwise, resulting from, or otherwise arising out of, use of the Services through Your account or using Your payment methods.
Proprietary rights and all other intellectual property rights owed by Omio Group or otherwise relating to the Service Sites are expressly reserved by Omio Group. Marks found on or through the Service Sites that are the property of Providers or other third-parties are used by permission. You may not distribute, modify, transmit, reuse, repost, or copy any marks or intellectual property contained on the Service Sites without the express prior written consent of Omio in each instance.
The Services are designed to make it easier for You to plan Your trips by equipping You with valuable information, by providing a clear comparison of available travel options. Although we may act as intermediaries between you and the Providers, we do not resell any travel tickets.
Our Services include:
1. Search engine & comparison platform
Based on the information You input into the Service Sites, We will provide You with a clear overview of potential travel options offered by Providers using certain methods of transportation (e.g. train, bus, plane, ferry or rental car). You can filter and compare the options by various criteria, such as price, travel duration, etc. As We rely on the information made available to Us by multiple third-parties, including but not limited to booking and information platforms, We cannot guarantee the accuracy or completeness of the options presented to You via the Service Sites. Your use of the Service Sites is at Your sole risk. Omio Group assumes no liability for any lack of travel availability at the time of booking, or for the manner or fulfilment of the services provided by any Provider.
2. External Bookings
For External Bookings, clicking on a link on the results page of the Service Sites will redirect You to a booking page on the Provider's website where You will have the opportunity to book and purchase the corresponding reservation. You are responsible for confirming that the reservation details and passenger information listed in such Provider’s booking page is correct as Omio expressly disclaims any responsibility for errors or discrepancies that may occur.
When you are linked to a Provider’s website to finalize your booking, Your reservation is not fully booked until You and the respective Provider conclude a contract for such reservation.
We receive a commission from the third-party provider for acting as an intermediary. Additional fees imposed by the respective Provider may also apply to External Bookings as set forth in the respective Provider Terms.
The Services are provided to You as a convenience, and We are not affiliated with or responsible for any content, action, or performance of any third-party websites, including but not limited to those owned or controlled by any Provider, to which We may link. Your use of such third-party websites or Provider services is strictly at Your own risk as Omio Group shall not be liable for any losses or damages that may be caused as a result of visiting such third-party websites. You should carefully review the Provider Terms and the applicable terms and conditions, privacy and data gathering policies before using any third-party website. If you proceed and conclude your External Booking on a Provider’s website, You agree to abide by such Provider Terms. Any changes to Your External Booking reservations, or cancellations thereof, must be made directly with the particular Provider.
Notwithstanding anything set forth herein to the contrary, You will abide by these Terms regardless of anything to the contrary in Your agreement with any Provider and You shall not use such Provider service to avoid the restrictions set forth in these Terms.
3. Direct Bookings
Certain Providers have been integrated directly into Our Services so that We may offer secure online booking options for such Provider services directly through the Service Sites. In these instances, You will not be redirected to the booking page of the respective Provider, but may book and purchase Your reservation through Us.
When purchasing a Direct Booking, You enter into two separate contracts: (i) one contract between You and the Provider for supplying the actual transportation, and (ii) one contract between You and Us for Your use of the Service Sites. By clicking on the "Pay Now" button on a Direct Booking reservation, You submit a binding offer to conclude a contract with Omio for Us to act as the intermediary between You and the direct travel Provider for their provision of the particular reservation listed on such Direct Booking page.
The contract governing your Direct Booking reservation with the Provider is only concluded once Your offer is accepted and You receive a booking confirmation notice. The booking confirmation notice is typically sent to You via email, together with all necessary travel documents and a receipt.
For Direct Bookings, We act as an intermediary between You and the Provider; We collect your data and payment in order to process such Direct Booking on behalf of the Provider. Direct Booking reservations are sold to You on behalf of, and on account of, the respective travel Provider. We are not responsible for the quality or manner of any services rendered, if any, by the Provider.
Where applicable, actual travel documents will be delivered via email in a common electronic format (such as PDF files or mobile ticket with QR code) as printable tickets issued directly by the Provider. Once received, You are responsible for the immediate inspection of all travel documents to ensure their accuracy. You must immediately notify Us of any errors, defects, or incorrect information appearing thereon in order to allow for the timely correction of such travel documents by contacting Our customer service team here: Help Center. If You should require a dedicated receipt to reflect the business nature of Your travel, kindly direct such detailed request to [email protected]
In some rare cases, particularly for certain connections, You may receive a booking code or ticket voucher in lieu of a printable e-ticket which must be redeemed or exchanged for an actual ticket at the specified point of departure (e.g., airport, train or bus station, etc.) prior to departure (at the ticket office or a ticket vending machine). In such case, You shall be solely responsible budgeting a reasonably sufficient time to ensure that such redemption or exchange is processed and completed before the time of departure.
We receive a commission from Provider(s) when You use the Service Sites to make a Direct Booking on Our website. Additional fees imposed by the respective Providers may also apply.
Should You wish to cancel Your Direct Booking and withdraw from your contract with the Provider, You agree to immediately contact Our customer service team by telephone or via email here: Help Center; and We will promptly relay Your cancellation request to the affected Provider(s). Notwithstanding the above, it may be possible for You to cancel Your booking directly with the Provider(s) if the Provider Terms expressly permit such direct cancellation. Notwithstanding the above, and depending on the timing and circumstances involved, we cannot guarantee that You will be able to successfully withdraw from your Direct Booking contract with the Provider(s). You agree to pay all applicable costs associated with the cancellation of Your Direct Booking reservations, as set forth in the affected Provider Terms.
We use Omio Travel GmbH (Warschauer Platz 12, 10245 Berlin), a subsidiary of GoEuro Corp., to facilitate most of Direct Booking transactions.
Notwithstanding the above, Direct Bookings with SNCF Travel services are intermediated by Omio Voyages SAS (registered within Atout France in Registre des opérateurs de voyages et de séjours under the number: IM075150024, with registered address in 27 rue Paul Bert, 78800 Houilles, France; and, financial guarantee: APST, 15 avenue Carnot, 75017 Paris, France). Omio Voyages SAS‘ Professional Civil Liability details are the following: i) Insurance broker: Cabinet FACT SarL, 14 place du Chapître, 51100 Reims, France; ii) Insurance company: Allianz IARD, 87 rue de Richelieu, 75002 Paris, France. Omio Voyages SAS is a subsidiary of Omio Travel GmbH. For the purpose of Direct Bookings on SNCF, Omio Voyages SAS is included in these Terms when referring to “Omio,” "GoEuro," "We," “Us,” and “Our.”
4. Provision of travel insurance
We arrange travel insurance in several languages and in multiple countries as a license-free "annex intermediary" (Section 34d, para. 8, no. 1 German Trade, Commerce and Industry Regulation Act). As an independent agent, We use products offered by AWP P&C - Dutch Branch, trading as Allianz Global Assistance Europe headquartered in the Netherlands: Poeldijkstraat 4, 1059 VM Amsterdam, The Netherlands ("Insurer").
The insurance that We offer is tailored to each specific booking request. Our insurance contracts are concluded directly between You and the Insurer. In accordance with Section 66 of the German Insurance Contract Act (VVG) We hereby provide information on the relevant authority for complaints: Versicherungsombudsmann e.V., Postfach 08063, 10006 Berlin, www.versicherungsombudsmann.de
You must be at least eighteen (18) years old to create an Omio account, or to otherwise use the Services or the Service Sites. Registered accounts are non-transferable. If You opt to create an Omio account, You can do so by either (i) logging-in using Your Facebook credentials, or (ii) entering Your email address and generate an eligible password. All information supplied when creating Your Omio account must be complete and correct and You agree to periodically update such information from time to time in order to keep it current.
Once registered, Your Omio account will remain active until it is deactivated or terminated. Accounts may be deactivated by Omio or by the account’s registered User, upon the delivery of two (2) days’ prior written notice. We reserve the right to immediately terminate any account, without delivering any notice, upon (i) any violation of these Terms, (ii) violation of any Provider Terms, (iii) using the Services or the Service Sites in connection with an intent to commit a criminal offence, (iv) fraud, or (v) abuse of the Services or the Service Sites.
6. Payments & Fees
You will be presented with a breakdown of the costs and fees that comprise the amount due for each booking, including fees charged by the Provider. You agree to pay, or authorize, the payment for all such fees, together with any additional fees or costs as may be incurred by Your credit card or payment service provider, if any. Your payment may only be made via the acceptable payment system(s) specified on the reservation booking page, whether on the Service Sites (for Direct Bookings), or on the Provider’s website (for External Bookings).
6.1. Service Fees
When booking directly on our website, we charge a booking fee for our service. The booking fees vary and will be displayed at the time of booking. When using a foreign currency, foreign transaction fees may also apply.
Please note that Our Service Fees are non-refundable. This is because Our Fees are charged for the intermediation services provided by Omio, which are fulfilled when the booking has been confirmed to You.
6.2. Card Processing Fees
We will also charge You with additional fees for using certain payment methods as stated by the applicable laws, i.e. if You use a corporate card or a tripartite system (American Express or Diners). These fees are non-refundable. Please note that Our systems automatically detect the payment method which is actually used by You and the corresponding additional fees are charged, if any.
6.3. Service Fees for changes or cancellations
Applicable for all bookings as of 19 April 2021 (included).
Depending on the third-party provider and fare type, you may be able to either cancel and get a refund for your ticket or change your ticket online, via Help Center, or directly with the third-party provider. We will generally inform you of the main conditions during the booking flow, but we strongly advise you to read and understand the third-party terms and conditions before completing your booking.
You may need to pay for any difference in cost for your new ticket and any applicable fees determined by the third-party providers. In addition, if you decide to change or cancel your flight or ferry ticket through our Help Center, Omio may charge you a fee for changes or cancellations for the service performed by our Customer Service team. Please note that our service fees do not include the amounts eventually charged by the third-party providers, according to their terms and conditions. Omio service fees are non-refundable.
Changes or cancellations processed through our Help Center may only be guaranteed, if your request is submitted at least 24 hours prior to the departure time of your trip for air tickets, or 72 hours for ferry tickets. Please keep in mind that this is always subject to the terms and conditions of the corresponding third-party provider, which may be more restrictive.
We won’t change, cancel, replace or refund fraudulent tickets.

*If your original booking was processed in a different currency than Euros, please note that an equivalent amount will be calculated using a system-wide rate, known as the base exchange rate. This rate is used for currency conversion using data from one or more third parties. We regularly update the base exchange rate, it may not, however, be identical to the real-time market rate.
A trip is considered Domestic when your city of departure and destination are located within the same country. As opposed to Domestic, a trip is considered Cross-border when your city of departure and destination are located in different countries.
Change means Your voluntary request to change the date, route or name of Your booking. Important to note that any change is subject to the conditions allowed by the carrier.
Cancellation means Your voluntary request to cancel your ticket(s).
A Processed Request means that after You contact our Customer Help Centre to change or cancel your booking, our agents process the corresponding change and/or cancellation. For the avoidance of doubt, if You wish to cancel or change two bookings, this will result in two separate requests.
7. Service Interruptions
We make the Service Sites available to You as a courtesy; You are not entitled to use the Services or the Service Sites, or to any specific functions thereof. Omio reserves the right to make changes or updates to the content or functionality of the Services and the Service Sites at any time. We make no guarantees as to the functionality, availability, or accessibility of the Service Sites. Technical problems or maintenance may lead to an inability for You to access or use the Service Sites.
8. Duties and Obligations of the User; Prohibited Activities
You are responsible for ensuring compliance with all governmental and Provider requirements (e.g., passport and visa requirements, entry requirements, customs and currency regulations, carry-on and baggage restrictions, vaccination requirements, and government warnings and recommendations) associated with Your booking. To ensure that each booking runs smoothly, please take note of all instructions and notices provided by Providers and Omio. We accept no liability if You are refused entry onto any travel service (e.g., bus, train, flight) or into any country due to Your failure to perform Your responsibilities in accordance with these Terms and Provider Terms.
As a condition of Your use of the Service Sites, you warrant that (1) You are at least eighteen (18) years old; (2) You possess the legal authority to enter into a binding legal contract; (3) You will use the Services or the Service Sites in accordance with these Terms and only to make legitimate reservations for You or for those other persons for whom You are legally authorized to act; (4) You will inform such other persons about these Terms and their application to every reservation that You have made on their behalf, including all applicable rules and restrictions; (5) all information supplied by You through the Service Sites is true, accurate, current, and complete; and (6) You shall safeguard Your Omio account credentials and will supervise and be completely responsible for any use thereof, whether by You or anyone else.
The content and information of the Service Sites and the infrastructure used to provide the Services is proprietary to Omio and its authorized licensees and third-party partners. While You may make limited copies of Your booking documents for reservations secured through the Service Sites, You agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through the Services Sites. Furthermore, You agree not to do any of the following:
- Use the Services or the Service Sites or the content of any of the same for any commercial purpose;
- Make any speculative, false, or fraudulent reservation in anticipation of demand;
- Access, monitor, or copy any content or information of the Service Sites using any robot, spider, scraper or any other means, whether automated or manually for any purpose without Our prior express written consent;
- Violate the restrictions in any robot exclusion headers on the Service Sites or circumvent other measures used to prevent or limit unauthorized access to the same;
- Do anything that would impose an unreasonable or excessive traffic or load on Our infrastructure;
- Deep-link to the Service Sites for any purpose;
- Incorporate any part of the Service Sites into any other website without Our express prior written consent.
We endeavor to ensure that the information presented on the Service Sites is accurate. When providing the Services, We rely on the information conveyed to Us by Providers. We are unable to verify the accuracy or completeness of all information that We gather and display on the Service Sites. Our reviews are carried out on an ad-hoc basis. YOUR USE OF THE SERVICES OR THE SERVICE SITES IS AT YOUR SOLE RISK AS EACH IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EXCEPT AS OTHERWISE SET FORTH ELSEWHERE IN THESE TERMS, OMIO GROUP MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES OF ANY KIND, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Omio Group does not warrant that (a) the Service Sites will function uninterrupted, secure or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service Sites are free of viruses or other harmful or malicious software or code; or (d) the results of using the Service Sites will meet Your requirements.
Omio Group shall bear no responsibility for the availability or provision of any Provider services at the time of each booking (on Provider websites) or for the actual delivery and satisfactory performance of actual travel services booked with any Provider. Any claims of breach of warranty or damages shall be brought directly against the affected Provider.
Omio Group’s liability, and that of Omio Groups’ respective employees, representatives, agents, shareholders, directors, or contractors shall be limited to damages incurred as a result of Omio Groups’ willful or gross negligence.
This limitation of liability shall not apply to (i) loss of life, (ii) serious bodily injury, (iii) breaches of warranty, (iv) or to material breach of contract (i.e. breach of any obligation that is essential to the proper performance of the contract).
TO THE EXTENT THAT A COURT OF COMPETENT JURISDICTION SHOULD DETERMINE THAT OMIO GROUP IS LIABLE FOR ANY LOSS OR DAMAGE SUFFERED BY ANY USER, SUCH USER’S ENTIRE RECOVERY SHALL BE CAPPED AT, AND SHALL NOT EXCEED, AN AMOUNT THAT IS EQUAL TO THE AMOUNT PAID BY SUCH USER TO OMIO GROUP.
If You reside in a jurisdiction that does not allow for the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, the limitations above will not apply to You.
You agree to defend and indemnify Omio Group, the Providers, and any officers, directors, shareholders, employees, and agents of the same from and against any claims, actions, demands, losses, penalties, or other costs of any kind, including legal fees, brought by third-parties as a result of (1) Your breach of these Terms; (2) Your violations of any law or the rights of any third-party; (3) Your use of the Service Sites.
The Services are continually evolving and expanding. Omio Group reserves the right, in Our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined in Our sole discretion. By continuing to use the Service Sites after any revised terms become effective, You agree to be bound by such revised terms. If You do not agree to the new terms, You are no longer authorized to use the Service Sites.

You retain any and all of Your rights to any Content You submit, post or display on or through the Service Sites and You are responsible for protecting those rights. We take not responsibility and assume no liability for Content You or any third-party should post. However, by posting or submitting Content through the Service Sites, You grant Us the right and perpetual, worldwide, transferrable, irrevocable, royalty-free license to use, modify, publicly perform, publicly display, reproduce, sublicense, and distribute such Content in any manner We should desire. You agree that this license includes the right for Us to make the Content available to other Users of the Service Sites.
Omio Group has the right, but not the obligation, to monitor any Content submitted. Inappropriate Content may be deleted or removed.

In accordance with Section 36 of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG), We hereby inform You that We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board. Users hereby waive all right to bring or otherwise participate in any class action lawsuit against Omio Group.
If you have a good faith belief that Omio Group has used any Content or other material that infringe upon your rights, please send Us a written notice that contains: a clear description of the work allegedly infringed upon; a link to the allegedly infringing material appearing on the Services; your full contact information; a statement that you have a good faith belief that the material appearing in the Services is not authorized by such material’s owner, its agent, or the law; and a signed, sworn statement under the penalties of perjury that you are authorized to act on behalf of the owner of said material. If your Content or material has been taken down, We suggest that you consult with an attorney before submitting any counter-notifications to Omio. You may file a counter-notification that includes the following: a clear description of the material that was removed and the location where such content appeared in the Services (please provide a URL, if possible); your full contact information; a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you r address is outside the United States, for any judicial district in which Omio may be found, and that you will accept service of process form the party who reported your material; and a sworn statement under the penalties of perjury that you have a good faith belief that the content identified above was removed or disabled as a result of a mistake or misidentification. Such counter-notification may be sent to [email protected]
If Your country of residence or establishment is outside of the United States: these Terms will be interpreted in accordance with German law, unless a different jurisdiction is applicable as per law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. The choice of law does not impact Your rights as a consumer according to the consumer protection regulations of Your country of residence. If You are acting as a consumer, You agree to submit to the non-exclusive jurisdiction of the German courts. Judicial proceedings that You are able to bring against Omio Group arising from or in connection with the Policies or the Services may only be brought in a court located in Germany or a court with jurisdiction in Your place of residence. If Omio Group wishes to enforce any of its rights against You as an individual consumer, We may do so only in courts of competent jurisdiction. If You are acting as a business, You agree to submit to the exclusive jurisdiction of the German courts.
If Your country of residence or establishment is the United States: these Terms will be interpreted in accordance with the laws of the State of New York and the United States of America, without regard to any choice of law or conflict-of-law principles. Further, You and Omio Group each agree that the venue of any litigation shall be in Manhattan, New York to resolve any dispute, claim, or controversy that relates to, or arises in connection with, the Policies or the Service (and any non-contractual disputes/claims relating to or arising in connection with them) and is not subject to mandatory arbitration. Parties and witnesses residing more than fifty miles from the venue may testify telephonically or via such other audio-visual means as the court may deem acceptable. You waive all right to participate in any class action lawsuit against Omio.
